नई दिल्ली: केरल के सबरीमाला मंदिर में प्रवेश को लेकर आज सुप्रीम कोर्ट ने महिलाओं के पक्ष में अहम फैसला सुनाया। कोर्ट के फैसले के तहत सबरीमाला मंदिर में महिलाओं की एंट्री पर लगी रोक अब खत्म हो गई है। सुप्रीम कोर्ट के 5 जजों की बेंच ने इस मामले में अपना ऐतिहासिक फैसला सुनाया। पांच जजों की बेंच ने 4-1 (पक्ष-विपक्ष) के हिसाब से फैसला सुनाया। करीब 800 साल पुराने इस मंदिर में ये मान्यता पिछले काफी समय से चल रही थी कि महिलाओं को मंदिर में प्रवेश ना करने दिया जाए।
सबरीमाला मंदिर में मिली सभी महिलाओं को एंट्री की इजाजत
वहीं, सुप्रीम कोर्ट के फैसले पर तृप्ति देसाई ने खुशी जताते हुए इसका स्वागत किया है। उन्होंने कहा कि कोर्ट के इस फैसले के बाद महिलाओं को न्याय मिला है और उन्हें समानता का अदिकार मिला है। वे अब जल्द ही सबरीमाला मंदिर जाएंगी। वहीं, सबरीमाला पर कोर्ट के इस फैसले को सनातन संस्था ने दुर्बाग्यपूर्ण बताया है।
चीफ जस्टिस दीपक मिश्रा ने कहा कि आस्था के नाम पर लिंगभेद नहीं किया जा सकता है। कानून और समाज का काम सभी को बराबरी से देखने का है। महिलाओं के लिए दोहरा मापदंड उनके सम्मान को कम करता है। चीफ जस्टिस ने कहा कि भगवान अयप्पा के भक्तों को अलग-अलग धर्मों में नहीं बांट सकते हैं। कोर्ट ने कहा कि अनुच्छेद 25 के मुताबिक सभी बराबर हैं। समाज में बदलाव दिखना जरूरी है, व्यक्तित्व गरिमा अलग चीज है। पहले महिलाओं पर पाबंदी उनको कमजोर मानकर लगाई गई थी।
महिलाओं को कम आंकना संविधान का उल्लंघन
जस्टिस नरीमन ने कहा कि महिलाओं को किसी भी स्तर से कमतर आंकना संविधान का उल्लंघन करना ही है। सुप्रीम कोर्ट के फैसले के बाद सबरीमाला मंदिर की ओर से याचिकाकर्ताओं ने कहा है कि वह इस पर रिव्यू पेटिशेन दायर करेंगे।
जस्टिस इंदु मल्होत्रा ने इस मामले पर सबरीमाला मंदिर के पक्ष में अपना फैसला पढ़ा। उन्होंने कहा कि धार्मिक आस्थाओं को आर्टिकल 14 के आधार पर नहीं मापा जा सकता है। जस्टिस मल्होत्रा ने कहा कि आस्था से जुड़े मामले को समाज को ही तय करना चाहिए ना की कोर्ट को। उन्होंने कहा कि सबरीमाला श्राइन के पास आर्टिकल 25 के तहत अधिकार है, इसलिए कोर्ट इन मामलों में दखल नहीं दे सकता है। उन्होंने कहा कि धार्मिक मान्यताएं भी बुनियादी अधिकारों को हिस्सा ही है।
जानिए क्यों लगी थी रोक?
केरल के पत्थनमथिट्टा जिले के पश्चिमी घाट की पहाड़ी पर स्थित सबरीमाला मंदिर प्रबंधन ने सुप्रीम कोर्ट को बताया था कि 10 से 50 वर्ष की आयु तक की महिलाओं के प्रवेश पर इसलिए प्रतिबंध लगाया गया है क्योंकि मासिक धर्म के समय वे शुद्धता बनाए नहीं रख सकतीं।
हालांकि शुरू के ही इस मामले में केरल सरकार महिलाओं के पक्ष में थी। इस मामले में 7 नवंबर, 2016 को केरल सरकार ने कोर्ट को सूचित किया था कि वह ऐतिहासिक सबरीमाला मंदिर में सभी आयु वर्ग की महिलाओं के प्रवेश के पक्ष में है। जिसके बाद तत्कालीन एलडीएफ सरकार ने 2007 में मंदिर में महिलाओं के प्रवेश की हिमायत की थी, जिसे कांग्रेस के नेतृत्व वाली यूडीएफ सरकार ने बदल दिया था। बाद में केरल सरकार ने सुप्रीम कोर्ट में अपना पक्ष रखते हुए एक बार फिर मंदिर में महिलाओं के प्रवेश पर सहमति जताई। राज्य सरकार का कहना था कि सरकार हर उम्र की महिलाओं के प्रवेश के समर्थन में है।
तब राज्य सरकार के इस स्टैंड पर चीफ जस्टिस दीपक मिश्रा ने सवाल उठाते हुए कहा था कि आपने चौथी बार स्टैंड बदला। जस्टिस रोहिंगटन ने कहा कि केरल वक्त के साथ बदल रहा है। 2015 में केरल सरकार ने महिलाओं के प्रवेश का समर्थन किया था, लेकिन 2017 में उसने अपना रुख बदल दिया था। जिसके बाद अब फिर उसने प्रवेश देने पर सहमति जताई।
